The WeatherXM application enables the user to connect certain supported mobile payment and Cryptocurrency wallet services (each a “Cryprocurrency Wallet”) offered through one or more software application(s) on the user’s eligible device with the WeatherXM system as follows: the user will simply register his/her address in a field as text that will be stored as text in WeatherXM’s system. There is no actual wallet connection and WeatherXM cannot take any action on behalf of the user related to his wallet. WeatherXM only has knowledge of his address and nothing else. The only functionality and use of this address is that WeatherXM can send the WXM tokens that the user is entitled to get as a reward.

Therefore:

1. If a user loses access to that wallet or it’s hacked, the WXM tokens that were in that address (as the address is part of the user’s wallet) should be considered lost and WeatherXM has no responsibility or obligation to provide a refund. The user agrees that his WXM tokens are considered lost.

2. The same applies when for any reason the wallet and the user fall victim to a hack, WeatherXM has no responsibility in this and is not obliged to any kind of refund. The user agrees that WXM token is considered lost or stolen.

3. Not all wallets support the WXM token. WeatherXM suggests specific wallets that support the WXM token and thus the user can see and use it (e.g. by making transactions with it or transferring it to other wallets). In the event that the user does not register with an address from one of these suggested wallets, but uses another one that does not natively support the WXM token, then it is the user’s responsibility to import their wallet or seed phrase into one of the suggested wallets so that they can access and manage the WXM they own. The user agrees that for any incorrect wallet selection is not WeatherXM’s responsibility or WeatherXM obligation to make any kind of refund if the user selects a wallet that does not support the WXM token.

No affiliation with Providers. Metamask, Trust Wallet, Coinbase, Binance, and any other provider of a Cryptocurrency Wallet are each referred to in this Agreement as a “Provider” and collectively as “Providers”.

WeatherXM is not affiliated with any Provider and does not represent or endorse any Provider and has no responsibility for (a) the safety, quality, accuracy, reliability, integrity or legality of any product, offer, loyalty program or other item that may be stored, redeemed and/or utilized as part of any process related to any Cryptocurrency Wallet, (b) the truth or accuracy of the description of any product or of any advice, opinion, offer, proposal, statement, data or other information displayed or distributed, purchased or paid for through any Cryptocurrency Wallet, or (c) the availability, integrity, or security of any Cryptocurrency Wallet.

LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WEATHERXM, OUR SUPPLIERS (OR OUR OR THEIR RESPECTIVE AFFILIATES, AGENTS, DIRECTORS, AND EMPLOYEES) BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, INABILITY TO USE, OR UNAVAILABILITY OF CONNECTION TO A CRYPTOCURRENCY WALLET. UNDER NO CIRCUMSTANCES WILL WE BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF YOUR WEATHERXM TOKENS IN A CRYPTOCURRENCY WALLET.  THESE LIMITATIONS OF LIABILITY APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE FOREGOING LIMITATIONS OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
